Under the background of hierarchical diagnosis and treatment, community home-based hospice care service is an important way to guarantee the right of citizens to a "good death". Community healthcare center is an important part of providing community home-based hospice. At present, there are some problems in community home-based hospice care in China, such as an imperfect legislation, low quantity and quality of hospice care professionals, and the inability to charge for some services. By drawing on domestic and foreign legislation and practical experience in the main responsibilities of the government, referral system, talent training and qualification certification, and service item charging system, we propose a legal system of community home-based hospice care that suits our country's national conditions, so as to promote the healthy development of community home-based hospice care in China.
